May term of Clinton Circuit Court held

A term of Clinton Circuit Court was held last Thursday, May 1 with Circuit Judge David L. Williams presiding

The following are cases in which some type of final resolutions, i.e. sentencing, plea agreements, were made, ruling issued or trial dates scheduled:

* During a pretrial conference, a plea agreement was reached in the case of Commonwealth vs. Patrick O. Taylor.

The Commonwealth recommended amending the charge of persistent felony offender first degree to second degree and upon a plea of guilty to the lesser charge and theft by deception, the defendant would receive a seven and one-half year sentence to serve, and run concurrent with cases in Logan, Simpson and Warren counties.

Final sentencing is scheduled for June 12.

* Sentencing was held in the case of Commonwealth vs. Tony Lowhorn, pursuant to a plea agreement reached on April 3.

The defendant pled guilty to theft by unlawful taking with a five-year sentence imposed, probated for five years with supervision. The sentence shall run concurrent with another Clinton Circuit Court indictment and he will receive credit for time served and pay restitution. A charge of criminal trespass third degree was dismissed.

* During a pretrial conference a plea agreement was reached in the case of Commonwealth vs. Sylvia Janette Ferguson.

The Commonwealth recommended dismissing the charges of failure to use child restraint device (two counts), operating a motor vehicle while under the influence first offense and failure to maintain insurance. Upon a plea of guilty to two counts of first degree wanton endangerment, the defendant would receive a four-year sentence on each count to run concurrent, probated for four years with supervision and she will be assessed by the Social Services clinician for long-term rehabilitation.

Final sentencing has been scheduled for June 12.

* During a pretrial conference, a plea agreement was reached in the cast of Commonwealth vs. Vanessa M. Ferrell.

The Commonwealth recommended dismissing the charge of possession of drug paraphernalia and upon a plea of guilty to possession of a controlled substance first degree the defendant shall receive a three-year sentence, pre-trial diverted for three years, supervised.

* During a revocation hearing in the case of Commonwealth vs. Richard Luttrell, charged with burglary second degree, assault second degree and persistent felony offender second degree, the defendant acknowledged that he abscounded, which was a violation of the conditions of his probation. The court directed his probation be revoked. The defendant will receive credit for any time served.

* Sentencing was held in the case of Commonwealth vs. Bobby Wayne Pillar, pursuant to an agreement being reached on April 3.

The defendant pled guilty to escape second degree with a five-year sentence imposed, probated for five years with supervision. He shall receive credit for time served and be assessed for the Clinton County Drug Court Program.

* During motion hour, a trial date of June 3 was set for Joseph Paul Coop, charged with receiving stolen property and two counts of second degree persistent felony offender.

* During a pretrial conference in the case of Commonwealth vs. Robert Leslie Smith, charged with theft by unlawful taking, receiving stolen property under $10,000 and three counts of first degree persistent felony offender, another pretrial conference was scheduled for June 12 and a trial date set for July 15.

* During arraignment, in the case of Commonwealth vs. Kyle Matthews, charged with third degree burglary and fourth degree assault, a pretrial conference was set for July 10 and a trial date for September 10.

* During a pretrial conference in the case of Commonwealth vs. Ashley McCusker, charged with first degree possession of a controlled substance first offense, the trial date scheduled for May 20 has been continued, with a pretrial conference set for August 14.

* During a pretrial conference in the case of Brittanie L. Thurman, charged with criminal mischief first degree, the trial date scheduled for July 9 has been continued, with a review set for September 11.

* In the case of Commonwealth vs. Michael Stearns, charged with possession of a controlled substance first offense and possession of drug paraphernalia, scheduled sentencing was continued until June 12.

Several other cases were on the docket last Monday, with other cases being continued for review, post-trial court dates scheduled and some defendants were arraigned, entering not guilty pleas and having pretrial conference dates scheduled.
