Murder trial for Byler, Thompson set for April

Another trial date has been scheduled for two Clinton County residents charged with murder in the death of Jimmy Sidwell, Jr., 19, also of Albany that occurred a year ago.

During motion hour last Thursday, October 9 in Clinton Circuit Court, Judge David L. Williams set aside a week–April 27 through May 1, 2015–for the trial of Michael E. Thompson and Andrea Byler, with a pretrial conference being scheduled for December 11 in the case. Judge Williams also sustained a motion in both cases to take the deposition of the medical examiner.

Byler is charged with murder and two counts of tampering with physical evidence, while Thompson is charged with murder, one count of tampering with physical evidence and one count of robbery.

Kentucky State Police arrested both defendants last October 27 and charged them in connection with Sidwell’s murder.

The victim, who police believe was killed elsewhere and his body moved, was discovered underneath an unoccupied trailer in south Albany on Cody Lane behind Lee’s Famous Recipe on the afternoon of Saturday, October 26.

Police said at the time, some people who were putting a roof on a nearby building saw the body under the trailer and called 911 Dispatch.

The victim, according to police, may have died a day or two before his body was discovered.

Preliminary autopsy results indicate the cause of death was multiple stab wounds to his upper body.

The lead investigator in the case is KSP Detective Ricky Brooks who was assisted at the scene by Albany Police Department, as officers from the APD were the first to arrive on the scene after the 911 call.

The original trial had been scheduled for this month, but during a motion hour on August 14, Judge Williams granted a continuance for both defendants, apparently to await test results related to the case.

Thompson is being represented by Brad Shuffett, a public advocate attorney and Byler is being represented by Monticello attorney Thomas Carroll. The case is being prosecuted by Commonwealth Attorney Jesse Stockton.
