Solid waste hauler areas will be reduced to three

Clinton County Fiscal Court held a short “special” called meeting last Thursday morning, October 15 with all court members on hand. The meeting was in lieu of the regular session and was changed to a special meeting due to the change in regular time (from 5 p.m. to 8 a.m.), due Foothills Festival booths being set up around the square last Thursday night.

There was a limited number of business items on the less than 20-minute meeting, with the most important issue being the approval of a first reading amending the county’s Solid Waste Management Ordinance, which passed by unanimous vote.

The amendment, which would go into effect officially on March 21, 2016, basically reduces–or in the current situation–keeps the number of franchise areas at three, instead of four areas under the previous ordinance.

The amendment change was necessary when one of the four original solid waste haulers decided to cease operations and the three remaining haulers worked amongst themselves to divide up the area formerly operated by Abston Sanitation and continue providing service to all county residents, which has been the case for about a year now.

The ordinance sets forth amendments to read, “The County of Clinton and City of Albany shall be divided into three (3) nearly equal and exclusive areas. The franchise areas for residential, business and industrial solid waste collection in the County of Clinton and City of Albany shall be defined as follows:

Area 1: Bounded by the east at the Clinton County and Wayne County line, thence west on Hwy. 90 to Ky. Hwy. 350. Following Ky. Hwy. 350 to Cross Street and Business Hwy. 127. Thence South on Business Hwy. 127 to the intersection of Ky. Hwy. 738. Thence following Ky. Hwy. 738 to the Kentucky and Tennessee State line. Also following the Kentucky and Tennessee State line east to Clinton County and Wayne County line and the Tennessee State line and following the Clinton County and Wayne County line to the point of beginning.

Area 2: Bounded by the Clinton County and Wayne County line and the Tennessee State line northeast to the end of Ky. Hwy. 553. Thence following Ky. Hwy. 553 to the intersection of Ky. Hwy. 553 and Ky. Hwy. 639, following Ky. Hwy. 639 in a north eastwardly direction to the intersection of the Old Burkesville Road and Ky. Hwy. 639, east to the Old Burkesville Road back to the intersection of Wood Street and Business Hwy. 127. Thence, from that point North Business Hwy. 127 back to the intersection at the 127 By-ass in a northerly direction to Ky. Hwy. 90 (caution light) thence north on Ky. Hwy. 734 to an intersection on Ky. Hwy. 734 and the 76 Falls Road (Hwy. 3062). Following the 76 Falls Road to a point at Old Seventy Creek on the 76 Falls Road. Thence following the waters of Old Seventy Creek and Lake Cumberland North to the Clinton County and Russell County line. The North boundary being the Clinton County and Russell County line. The West boundary being the Clinton County and Cumberland County line back to the point of beginning.

Area 3: Section One: Bounded by the Clinton County and Cumberland County line and the Tennessee State line. In a Northeast direction to the end of Ky. Hwy. 553 (Waters of Dale Hollow Lake) to the intersection of Ky. Hwy. 553 and Ky. Hwy. 639, following Ky. Hwy. 639 in a north eastwardly direction to the intersection of the Old Burkesville Road and Ky. Hwy. 639, thence east to the Old Burkesville Road back to the intersection of Wood Street and Business Hwy. 127. Thence, south Business Hwy. 127 to the intersection of Ky. Hwy. 738, in a southwest direction to the end of Ky. Hwy. 738 from that point to the point of beginning at the Clinton County and Cumberland County line and also the Tennessee State line.

Section Two: Bounded by the east at the Clinton County and Wayne County line, west on Ky. Hwy. 90 to Ky. Hwy. 350, thence south following Ky. Hwy. 350 to Cross Street and Business Hwy. 127. North Business Hwy. 127 back to the intersection of Business Hwy. 127 and the By-pass and traveling north to the intersection of Ky. Hwy. 90 and 127 By-pass (caution light) then north on Ky. Hwy. 734 to an intersection of Ky. Hwy. 734 and the Seventy Six Falls Road and following that road to a point at Old Seventy Creek on the Seventy Six Falls Road. From there follows the waters of Old Seventy Creek and Lake Cumberland north to the Clinton County and Russell County line. Bounded northeastwardly by the Clinton County and Russell County line then to a point of Clinton County and Russell County line. Following the county boundaries of Wayne County and Clinton County back to the point of beginning.

Second and final reading of the amended ordinance will be held next month.

The court also voted to make final payment for completion work on the pool heating system at the Twin Lakes Family Wellness Center.

The project was funded when the fiscal court approved a loan to have the new system installed, with the stipulation that the Wellness Center would repay the county on a monthly basis until the amount of the loan was paid in full.

The court voted to hire Tammy Garrett for a two-day period to clean the courthouse during the Foothills Festival Friday and Saturday, October 16 and 17 at a rate of $100 and deferred action until next month on considering proposals for the recycle trailer lettering until additional quotes can be obtained.

Prior to administrative items, the court approved the monthly and quarterly treasurer’s reports, fund transfers, and voted to pay claims and bills, with the exception of envelopes for the sheriff’s office, which will be paid with sheriff’s department funds.

The next meeting of Clinton Fiscal Court is scheduled as a special call meeting on Tuesday, November 17 at 8 a.m. and is open to the general public.
