November term of Clinton Circuit Court held

A session of Clinton Circuit Court was held a week ago Thursday, November 3 with Circuit Judge David L. Williams presiding over the docket.

The following are cases in which some type of resolutions were reached:

* Sentencing was held in the case of Commonwealth vs. William L. Wood, charged with flagrant nonsupport, pursuant to a jury trial in the case conducted on October 5.

The jury found the defendant guilty on the charge and the court followed the jury recommendation that the defendant receive a sentence of one and one-half years imprisonment. The Commonwealth opposed probation and the sentence recommended by the jury was handed down by the court.

* Sentencing was held in the case of Commonwealth vs. Stephanie Myers, pursuant to a motion to revoke pretrial diversion, having been heard on October 13. During that hearing the court determined the defendant had violated terms of her pretrial diversion.

The court found the defendant guilty of possession of a controlled substance first degree (meth) with a three year sentence imposed. The defendant shall serve an additional 26 days in jail with the balance of the sentence probated for five years with supervision and will receive credit for time served.

* During an arraignment, a plea agreement was reached in the case of Commonwealth vs. Cody Owens.

The Commonwealth recommended dismissing the charges of criminal trespass third degree and possession of drug paraphernalia. Upon a plea of guilty to possession of a controlled substance first degree, the defendant would receive a two-year sentence, pretrial diverted for two years with supervision.

* During a case review, in the case of Commonwealth vs. William Allen Sheckles, the court determined the defendant had not made ordered payments and found him in contempt of court. He would purge himself from contempt by paying a lump sum of $375. The case will be reviewed December 1 and the defendant is to be present regardless of whether the payment has been made.

* During a pretrial conference, in the case of Commonwealth vs. George W. Cole, charged with unlawful imprisonment and sexual abuse, the trial scheduled for December 12 was continued with a pretrial conference scheduled for December 1.

* During a pretrial conference in the case of Commonwealth vs. Johnny L. Burchett, charged with trafficking in a controlled substance, possession of drug paraphernalia and persistent felony offender, the trial date of November 21-22 was continued with a pretrial conference scheduled for December 1.

* During a pretrial conference in the case of Commonwealth vs. Michael K. Asberry, charged with assault and theft by unlawful taking or disposition, the court noted the trial remains set for January 18, 2017.

* During a review, in the case of Commonwealth vs. Brian Hale, originally charged with trafficking in a controlled substance, the court noted an agreed order was previously entered dismissing this action.

* During a pretrial conference, in the case of Commonwealth vs. Brian L. Martin, originally charged with drug related offenses including manufacturing methamphetamine, upon the request of the Commonwealth, the matter was dismissed without prejudice.

* During a pretrial conference in the case of Commonwealth vs. Jacqueline S. Martin, originally charged with drug related offenses including manufacturing methamphetamine, upon request of the Commonwealth, the matter was dismissed without prejudice.

* During a review in the case of Commonwealth vs. Tommy Eugene Phillips, charged with theft by unlawful taking and persistent felony offender, the defendant did not appear, a warrant of arrest was issued and the defendant is to be placed in NCIC.

Several other cases were on the docket, some being continued for various reasons and other defendants were arraigned on charges with only pretrial conference dates being scheduled at this time.
