A Wayne County man accused of murder in the shooting death of his brother-in-law entered a not guilty plea to the charge during an arraignment held Monday, December 16.

Tim Reynolds made his initial appearance in Wayne Circuit Court on Monday with his attorney Lance Turner.

Reynolds also entered a not guilty plea to the charge of tampering with physical evidence. He was indicted on the charges by a local grand jury on November 26. The charges stem from the shooting death of Mark Duncan, 52, which occurred in the Meadow Creek community on September 24.

According to state police, the investigation indicated that the two family members were involved in a disagreement that lead Reynolds to shoot Duncan.

The citation alleges that Reynolds said he shot Duncan multiple times, hit him over the head with a wrench and then returned home to report the incident and wait for law enforcement to arrive.

Duncan was found lying on the ground near his residence on Duncan Road.

Reynolds was arrested on the charges shortly after the shooting occurred. He was released from custody on a property bond that was posted on November 27, according to court records.

A pretrial conference in the case is set for March 3 in Wayne Circuit Court.

Four pieces of property along KY 90 and Bypass 90 are now part of the City of Monticello. The city council met in special session on Tuesday, December 17 and unanimously approved the second reading of the two ordinances annexing the property into Monticello’s corporate limits.

One of the ordinances included Cumberland Farm Products and the property next to it, which is owned by Don Sidwell.

The other ordinance included the Don Franklin dealership and the property adjacent to it where a new medical facility recently opened.

The annexation process began several months ago, when the council introduced ordinances regarding their intent to take in those pieces of property.

The ordinances regarding the intent for annexation were approved by the council in October.

There was then a 60-day period when property owners could petition for a vote on the annexation. That passed earlier this month and the council moved to the next step.

Property owners for all four parcels of land were notified of the annexation plans and invited to attend meetings the prior week.

Joe McPheron, representing Don Franklin, was at the special meeting held on December 16. No property owners were at the meting on Tuesday, December 17, when the council took action on the ordinances.

During his appearance on Monday night, McPheron expressed the dealership’s interest in regard to a possible economic development incentive between the city and the business. He noted that they made an extensive investment in the property, including more than $1 million in excavating and other site work.

The agenda for Tuesday’s meeting included a discussion about the economic incentive or contract with Don Franklin.

Mayor Tracie Sexton said that she had not received the information she expected to receive regarding the specific amount of money spent by Don Franklin at the site.

At that point, the council opted to table the discusssion and adjourn the meeting.
