Grand jury returns several multi-count true bills during February session

The Clinton County Grand Jury convened in regular session on Thursday, February 6, and handed down the following indictments in open circuit court:

* Justin Joe Daley: The alleged offenses of receiving stolen property (over $10,000), Class C felony; arson 2nd degree, Class B felony; obscuring the identity of a machine or other property, Class C felony; persistent felony offense (three counts); possession of a firearm by a convicted felon, Class D felony;and persistent felony offender first degree.

The alleged incidents occurred on or about January 12, 2020 involving retaining and burning of a travel trailer belonging to another person. And, the offenses having been committed when the defendant had been convicted of a prior felony offense within the past five years.

* Michael Keith: The alleged offense of receiving stolen property (over $10,000), Class C felony; arson 2nd degree, Class B felony; obscuring the identity of a machine or other property, Class C felony; persistent felony offender first degree (three counts).

The alleged offenses occurred on or about January 12, 2020 involving the retaining or disposing and burning of a travel trailer, while the defendant had been stood convicted of a prior felony offense within the past five years.

* Tony Lowhorn: The allege offenses of receiving stolen property, Class D felony; persistent felony offender first degree; theft by unlawful taking or disposition, Class D felony; and another count of persistent felony offender first degree.

The alleged offenses involve a stolen tool box and three aluminum wheels, with the offenses having occurred on or abut January 17, 2020 and January 20, 2020. And when the defendant had been found guilty of a prior felony offense within the past five years.

* Ricky Phillips: The alleged offense of receiving stolen property (over $10,000), Class C felony; arson 2nd degree, Class B felony; and obscuring the identity of a machine or other property.

The alleged incidents involve the retaining or disposal and burning of a travel trailer belonging to another and occurred on or about January 12, 2020.

* Steven Bell: The alleged offenses of assault 3rd degree, Class D felony (two charges) and two counts of persistent felony offender first degree.

The alleged incidents involve the “shoving, hitting and kicking” of a deputy jailer and jailer on or about November 29, 2019 and occurred when the defendant had previously been found guilty of a felony offense within the past five years.

* John Earl Wray: The alleged offenses of possession of a controlled substance first degree, Class D felony; public intoxication (Class B misdemeanor); disorderly conduct 2nd degree (Class B misdemeanor); assault 3rd degree (two counts), Class D felonies; and terroristic threatening 3rd degree (two counts–Class B misdemeanors).

The alleged offenses, all of which occurred on or about December 30, 2019, involve possessing items that could be used in making of methamphetamine and assaulting and threatening two deputy jailers.

* Misty Duvall: The alleged offenses of resisting arrest (Class A misdemeanor); possession of a controlled substance third degree (first offense); tampering with physical evidence (Class D felony); possession of a controlled substance first degree, Class D felony, by possessing items that could be used to make methamphetamine; driving on a suspended license (misdemeanor); and persistent felony offender 2nd degree, by having committed the offenses after having stood convicted of a felony offense within the past five years.

The alleged offenses occurred on or about January 8, 2020.

* Brian Burchett: The alleged offenses of possession of marijuana (Class B misdemeanor); possession of drug paraphernalia (Class A misdemeanor); trafficking in a controlled substance first degree (first offense) by distributing or dispensing meth with intent to distribute, Class D felony; and persistent felony offender first degree by committing the offenses after having been convicted of a prior felony offense within the past five years.

The alleged offenses having occurred on or about January 24, 2020.

* Heather D. Bell: The alleged offenses of possession of a controlled substance first degree, Class D felony, by having items that could be used in the manufacture of methamphetamine and promoting contraband in the first degree, by concealing a small amount of meth in her clothing at the Clinton County Jail, a Class D felony.

The alleged offenses occurred on or about January 6, 2020.

* Brett McFall: The alleged offense of promoting contraband in the first degree by concealing four buspirone pills while lodged in the Clinton County Jail, a Class D felony.

The alleged offense having occurred on or about December 9, 2019.

* Russell G. Daley: Criminal facilitation possession of a firearm by a convicted felon, a Class A misdemeanor. The alleged violation having occurred on or about January 7, 2020.
