The “attempted murder” trial of a Russell County woman won’t get underway until spring of next year, according to Commonwealth Attorney Matthew Leveridge.
The trial of Pamela Bennett did not begin as originally planned last Wednesday in Russell Circuit Court.
Bennett is accused of firing several shots from a rifle at Felicia Eads while she was inside a vehicle moments before Eads was fatally gunned down by Trevor Bennett, Pamela Bennett’s son.
That shooting took place the evening of November 2, 2010, in the driveway of a residence on Old Eli Road.
Trevor Bennett was charged, and later pled guilty to, manslaughter.
According to Leveridge, the proceedings didn’t begin on time last Wednesday as only 49 of 85 jury members showed up.
Circuit Judge Vernon Miniard, Jr. had court officials to call absent jury members during a recess but by 11 a.m. only 10 other jurors had showed up at the judicial center.
Leveridge said the process of screening perspective jurors got underway but the number of potential jurors fell below 32, which is the number required in order for the prosecution and defense to begin issuing their allotted number of strikes to reach a group of 12 final jurors in the case.
Miniard continued the proceedings and rescheduled Bennett’s trial for March 20, 2013.
A third person, 56-year-old Virgis Ward, was indicted in May of this year on a charge of facilitation to commit murder in Eads’ death.
